1. Agreement to these Terms
By creating an account, purchasing a service, or using Hosting, you agree to these Terms of Service, the Acceptable Use Policy, the Refund & Cancellation Policy, and any service-specific terms presented at checkout. If you do not agree, do not create an account or use the service.
2. Eligibility and account responsibility
You must be legally able to enter into a binding agreement in your jurisdiction. You are responsible for the accuracy of account information, safeguarding credentials, activity performed through your account, and promptly notifying Hosting of suspected unauthorized access. You may not share access in a way that defeats account, billing, security, or resource controls.
3. Services
Hosting provides hosted game-server services and related control-panel features. Service specifications shown at checkout, including memory, storage, CPU allocation, software, and included features, form part of your service description. Features may evolve over time, provided changes do not intentionally remove prepaid core resources during the applicable paid term without an appropriate remedy required by law.
4. Billing, renewals, taxes, and authorization
Paid plans are billed in advance on a recurring basis unless stated otherwise. By purchasing a recurring service, you authorize Hosting and its payment processor to charge the payment method associated with your account at each renewal until you cancel. Prices are shown before checkout and applicable taxes may be calculated and collected by the payment processor. You are responsible for taxes, fees, and charges that legally apply to your purchase.
Failed or disputed payments may result in service suspension, termination, or data-retention procedures described in these Terms and the Refund & Cancellation Policy.
5. Cancellation and plan changes
Unless otherwise stated, customer-requested cancellation takes effect at the end of the current paid billing period. The service remains available through that period and does not renew. Upgrades may take effect immediately and may include prorated billing. Downgrades generally take effect at the next renewal and may be blocked when current disk or backup usage exceeds the target plan limits.
Refund eligibility is governed by the Refund & Cancellation Policy and applicable law. Cancellation of renewal does not itself create a right to a prorated refund.
6. Resource limits and fair use
You must remain within purchased or assigned resource limits. Hosting may enforce storage quotas, memory limits, CPU allocation, network controls, backup limits, player limits where applicable, and other technical restrictions. You may not intentionally bypass, evade, or interfere with those controls. Excessive or abusive activity that harms platform stability or other customers may be restricted or suspended.
7. Customer data, worlds, files, and backups
You retain responsibility for content you upload or create through the service, including worlds, configurations, plugins, logs, and other server data. You grant Hosting the limited rights necessary to host, copy, transmit, back up, restore, and process that content solely to operate, secure, maintain, and support the service.
Unless a plan expressly includes a backup commitment, backups are not guaranteed. Even where backup features are available, you should maintain independent copies of important data. Hosting is not a long-term archival service. Data may be permanently deleted following cancellation, termination, expiration of a retention period, or an immediate administrative termination permitted by these Terms.
8. Acceptable use and prohibited conduct
You must comply with the Acceptable Use Policy. Prohibited activity includes unlawful use, attacks or attempted compromise of systems or networks, malware, credential theft, abuse of platform resources, evasion of security controls, and other conduct described in that policy. Hosting may investigate suspected violations and take protective action when reasonably necessary.
9. Suspension and termination
Hosting may suspend or terminate service for material violations of these Terms, the Acceptable Use Policy, nonpayment, fraud, security threats, legal requirements, abuse, or conduct that creates material risk to the service or others. Serious abuse or Terms violations may result in immediate termination and permanent deletion of managed server data. Immediate administrative termination does not automatically include a prorated refund, except where required by law.
10. Availability, maintenance, and service changes
Hosting will make commercially reasonable efforts to operate the service reliably, but no uninterrupted or error-free availability is promised unless a separate written service-level agreement expressly says otherwise. Maintenance, software updates, hardware failures, network incidents, attacks, provider outages, and events beyond reasonable control may cause downtime or degraded performance.
11. Third-party software and services
The service may rely on third parties, including payment processors, network providers, game software, plugins, and upstream infrastructure. Your use of third-party software remains subject to applicable third-party licenses and rules. Hosting is an independent hosting provider and is not affiliated with or endorsed by Mojang Studios, Microsoft, or other third-party game publishers unless expressly stated.
12. Intellectual property
Hosting owns or licenses the platform software, branding, website content, and related materials, excluding customer content and third-party intellectual property. You may not copy, reverse engineer, exploit, or use the platform or branding except as allowed by law or with written permission.
13. Disclaimer of warranties
To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis. Hostingdisclaims warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by law, Hosting will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of goodwill, or loss of data arising from the service. To the maximum extent permitted by law, Hosting’s aggregate liability arising from a claim relating to a paid service will not exceed the amount you paid to Hosting for that service during the three months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Hosting harmless from third-party claims, damages, and reasonable costs arising from your unlawful content, misuse of the service, or material violation of these Terms or the Acceptable Use Policy.
16. Changes to these Terms
Hosting may update these Terms as the service, law, or business changes. Material updates may require renewed acceptance before certain account or purchase actions. The version and effective date shown on this page identify the terms currently presented for acceptance.
17. Governing rules and severability
These Terms are governed by the laws applicable to the jurisdiction in which Hosting is established, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise. If a provision is found unenforceable, the remaining provisions continue in effect.
